It was written from what the application actually does, but the operator’s details and contact address have not been filled in, and it has not been reviewed by a lawyer. Do not rely on it yet.

Terms of Service

These terms apply between you and the operator of CASHew (“we”, “us”) and cover your use of CASHew at cashew.work. Using the service means accepting them.

What this is

CASHew records invoices and expenses and produces financial statements from them — a profit and loss, a balance sheet, a cash flow statement and a GST summary.

It is a record-keeping tool, not an accountant. The figures it produces depend entirely on what you enter and on choices you make, such as whether to report on a cash or accrual basis. Nothing here is accounting, taxation or financial advice, and no one has reviewed your figures. Check them with a registered agent before you lodge anything or rely on them for a decision.

Who can use it

You must be at least 16 and able to form a binding contract. If you use it for a business, you confirm you may accept these terms on that business’s behalf.

Your account

  • Keep your password to yourself; you are responsible for what happens under your account.
  • Give a real email address — it is how the account is recovered, and it is the only way.
  • One account is one business. There is no shared or multi-user access.
  • Tell us promptly if you think someone else has your account.

What you may not do

  • Break the law with it, or use it to help someone else do so.
  • Upload malware, or attachments you have no right to store.
  • Try to reach another account’s data, or probe, scan or overload the service.
  • Resell it, or run it as a service for other people.

Your records

Your records remain yours. We claim no ownership of them, and we use them only to run the service for you — never to train anything, sell anything, or advertise.

You are responsible for what you record about other people. If you store a client’s or supplier’s details, you are the one accountable to them for it.

Keep your own copies. Australian tax law generally requires records to be kept for five years, and that obligation is yours, not ours. The Reports page exports everything as CSV; do it regularly.

Availability

The service is provided as it is. There is no uptime guarantee, no support desk, and no promise that a feature will keep existing. It may be interrupted for maintenance, or by a failure at one of the providers it depends on.

Backups are not a feature. The database provider keeps its own, on its own schedule, for its own purposes. Do not treat them as your backup.

Ending it

You may stop using the service at any time and ask for your account to be deleted. We may suspend or close an account that breaches these terms, or withdraw the service altogether — with reasonable notice where circumstances allow, so you can export your records.

Liability

Nothing here excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded.

Subject to that, the service is provided without warranties, and we are not liable for indirect or consequential loss, lost profits, or lost or corrupted data. In particular we are not liable for a tax position taken, a lodgement made, or a decision reached on the strength of figures the service produced. Where liability cannot be excluded, it is limited to re-supplying the service.

Privacy

What is collected and who sees it is set out in the Privacy Policy, which forms part of these terms.

Governing law

These terms are governed by the law of Victoria, Australia, and its courts have non-exclusive jurisdiction.

Changes

These terms may change. The current version is always on this page and the date at the foot is updated. Continuing to use the service after a change means accepting it.
